How we can help you claim compensation for stabbing injuries

Our criminal injuries solicitors help victims of violent crime to claim compensation for their injuries. There are various options we can use to secure fair payment for stabbing injuries under even the most challenging circumstances.

Claiming compensation for stabbing through the Criminal Injuries Compensation Authority (CICA)

The Criminal Injuries Compensation Authority (CICA) is a government body set up to make payments to blameless victims of crime.

We can help you make an application to the CICA, ensuring all of the relevant facts are highlighted, to maximise your chances of success and to maximise the potential award. An investigation will then be conducted, which will include speaking to the applicant and obtaining medical evidence about their injuries. We can give you all the help and support you need throughout this process.

The CICA will then decide whether compensation is appropriate and how much to pay out based on the results of their investigation. If you are unhappy with the level of compensation offered, or if no compensation is offered, you then have the option to appeal. The maximum compensation from the CICA is £500,000.00.

Our criminal injuries solicitors have very strong experience with CICA applications and investigations, as well as appeals against CICA decisions.

We know exactly what the CICA looks for when deciding whether to award compensation for stab wounds and how much to award, so can help to ensure your case is presented in the most effective way to maximise your chances of achieving a fair settlement.

Where an appeal is required, we can carefully craft the necessary arguments to persuade the CICA that a payment is appropriate, if at all possible. In the event this is unsuccessful, we can also advise you of your right to appeal to a tribunal for a final review of the CICA’s decision.

Making a personal injury claim against your assailant

If your claim is rejected by the CICA, or they judge that it is worth less than £1,000 and therefore they will not pay compensation, you may consider making a separate personal injury claim against your assailant.

There is no upper or lower limit on the value of a personal injury claim.  However, the amount you can actually recover will be entirely dependent on your assailant’s ability to pay.

This means it is often not worth pursuing a personal injury claim for stabbing against the individual, unless you are confident the guilty party has sufficient financial means to cover the value of any compensation awarded by a court.

Common questions about stabbing injury compensation claims

Am I eligible for compensation for being stabbed?

If you were injured when stabbed by someone else through no fault of your own, you are likely to be eligible for some form of stabbing compensation. Even if you are deemed to have some degree of fault, you may still be eligible to make a claim, so we always advise contacting our criminal injuries solicitors to discuss this.

If a loved one died as a result of a stabbing injury, you may be able to make a claim for the impact this has had on your life and those of other close family members of the deceased.

You may also be able to make a claim on behalf of the victim if they are under the age of 18, or if they have been left without the mental capacity to make a claim themselves.

How much compensation can you claim for getting stabbed?

This will depend on the circumstances, including how serious the injuries are and the impact this has had on your life. Criminal Injuries Compensation Authority (CICA) claims are capped at £500,000, although the overwhelming majority of claims are valued at under £25,000.

If you wish to pursue a separate personal injury claim against the person who stabbed you, the amount you can recover is not capped in the same way. However, it is important to bear in mind that your assailant will not necessarily have the means to make payment of any substantial settlement, so this option should be very carefully considered.

We will be happy to discuss the potential value of your claim during your initial consultation and will aim to give a realistic valuation as soon as possible, following an independent medical assessment. This will give you a clear picture of how much compensation you may be entitled to, allowing you to make an informed decision about how to move forward.

How long do you have to claim compensation for a stabbing injury?

You will normally have 2 years from the time of the stabbing and the report to the police, to make a claim through the Criminal Injuries Compensation Authority (CICA). However, different time limits can sometimes apply, depending on the circumstances.

If you are making a separate personal injury claim against your assailant, you will normally have 3 years from the date of the stabbing to bring a claim.
